On November 4, 2022, the invalidation claimant, Zhongke Shengkang, filed a request for invalidation with the State Intellectual Property Office on the grounds that the claims of the company's invention patent of "a hemostat" (patent number: 201410222753.7) were not inventive. After the examination of the Patent Office of the State Intellectual Property Office, the "Decision on the Examination of the Request for Invalidation shall be served on the company", the details are as follows:

Requester for invalidation: Beijing Zhongke Shengkang Technology Co., Ltd

Patentee: Nanwei Medical Technology Co., Ltd

Patents involved: The company owns the invention patent of "a hemostatic clip" (patent number: 201410222753.7).

After examining the request for invalidation filed by the applicant for invalidation on the above-mentioned patent right, the State Intellectual Property Office did not support the reasons of the applicant for invalidation and made the following decisions:

On the basis of claims 1-8 submitted by the patentee on November 10, 2020, the patent for invention No. 201410222753.7 is maintained.

2. This matter involves the previous litigation

Because the related products of Zhongke Shengkang (i.e., the applicant for this invalidation) are suspected of infringing the company's invention patent "a hemostatic clip" (Patent No.: 201410222753.7), in September 2022, the company launched an infringement lawsuit against Zhongke Shengkang, requesting the court to order it to immediately stop manufacturing and selling and destroying the relevant infringing products, and at the same time compensate the company for economic losses of 5 million yuan and reasonable rights protection expenses of 500,000 yuan, Beijing Intellectual Property Court ruled in the first instance that Zhongke Shengkang stopped the infringement and compensated the company 700,000 yuan, and Zhongke Shengkang was dissatisfied with the first-instance judgment and appealed to the Supreme People's Court. As of the date of this announcement, the case is still under trial.

3. The impact of the event on the company's profit and loss

In view of the review and decision of the State Intellectual Property Office, the invention patent "a hemostatic clip" (patent number: 201410222753.7) owned by the company remains valid on the basis of claims 1-8 submitted on November 10, 2020, therefore, this matter will not have a negative impact on the company's daily production and operation, nor will it have a negative impact on the company's current and future profit and loss.
