Zhu Tao stated in the proposal that the World Health Organization advocates a rapid and effective response to abnormal vaccination reactions to avoid weakening public confidence in vaccines, which will have a significant impact on immunization coverage and prevalence. Therefore, major countries around the world, including the United States, have established compensation systems for abnormal vaccination reactions as a safety net against the risk of vaccine damage.
In fact, my country has had a compensation system for abnormal vaccination reactions since the State Council promulgated the Regulations on the Administration of Vaccine Circulation and Vaccination in 2005 (State Council Order No. 434), which was revised in 2016 (State Council Order No. 668). The the People's Republic of China Vaccine Management Law promulgated in 2019 clarified that the country implements a compensation system for abnormal vaccination reactions. The following year, the General Office of the National Health Commission issued the ''Reference Catalog and Description of the Scope of Compensation for Abnormal Vaccination Reactions (2020 Edition) ''. The investigation, diagnosis, identification and compensation of abnormal vaccination reactions provide a certain reference range.
However, in recent years, society and the public have become increasingly concerned about abnormal reactions to vaccination. Especially after the period of mass vaccination of the new crown vaccine, the problem of the compensation system for abnormal reactions to vaccination in China has become increasingly prominent. In Zhu Tao's view, the current problems are mainly reflected in the following three aspects-
First, at present, the specific measures for compensation for abnormal reactions to vaccination are formulated and implemented by the provincial governments, and the national compensation measures have not yet been promulgated, resulting in excessive differences in specific compensation standards and procedures in different regions. At the same time, the time of compensation payment is not uniform, and some places limit the time for accepting compensation applications.
Second, in actual judgment, the identification criteria for not excluding abnormal reactions are not uniform among local investigation and diagnosis expert groups. This may lead to large differences in pharmacovigilance data of the same vaccine product in different provinces and cities, and the public will question the safety of vaccine products.
Third, the State encourages the establishment of mechanisms to compensate recipients of abnormal reactions to vaccination through commercial insurance and other forms. Jiangsu, Guangdong and other places have also carried out pilot attempts to change the compensation mechanism for abnormal vaccine reactions from "financial compensation" to "insurance compensation". However, as far as the current pilot experience is concerned, the improvement effect brought about by the shift from "financial compensation" to "insurance compensation" is basically at the operational level, and is mainly aimed at the operation of government compensation, which neither solves the gap between the payment standards of no-fault compensation and civil compensation, nor fails to socialize the corporate responsibility of the second type of vaccine damage compensation.
In response to the current problems, Zhu Tao put forward three suggestions.
recommendation 1: as soon as possible the introduction of national vaccination abnormal reaction compensation measures implementation rules, unified compensation standards and processes. Guide all localities to properly compensate for abnormal reactions to vaccination, ensure the smooth development of vaccination work, and maintain social harmony and stability.
Recommendation 2: Improve the identification methods for abnormal reactions to vaccination and clarify and unify the identification standards. Explore and carry out relevant epidemiological studies to provide a scientific basis for the causal determination of abnormal reactions. Promote the establishment of a scientific identification standard system to provide real safety data support for the export of domestic vaccines.
Recommendation 3: Explore the establishment of a national public compensation mechanism for abnormal reactions to vaccination. With reference to advanced international experience, explore the fund system, transfer compensation responsibility to the producer community, and realize vaccine risk sharing within the community.
