(Yicai) July 27 -- Eve Energy, a leading Chinese lithium battery maker, said that based on complete technology traceability and patent comparison analysis, it has never infringed a patent of South Korean peer LG Energy Solution and its subsidiary LG Energy Solution Arizona.

Eve Energy will review all materials related to the case, set up a professional legal team to respond to the allegations made by LG Energy and its unit, and defend its legitimate rights and interests by legal means in accordance with US legal procedures, the Huizhou-based company announced late on July 24.

LG Energy and its Arizona subsidiary reportedly filed a patent infringement lawsuit against Eve Energy in the ‌US District Court for the Eastern District of Texas on July 21, applying to the US International Trade Commission to initiate a Section 337 investigation, the Chinese firm said.

However, Eve Energy has not yet received any formal legal documents issued by competent institutions regarding the case, it pointed out, without disclosing further details.

Eve Energy always takes independent technological innovation as its core development foundation, it said. The company has over 17,000 patents worldwide and a complete patent barrier covering the entire battery supply chain, it noted, adding that it has applied for more than 3,000 independent innovation patents in the cylindrical batteries area and has not infringed on LG Energy's patent rights involved in the case.

In addition, Eve Energy has always advocated for the industry to engage in intellectual property dialogues based on objective facts, promote fair and orderly competition in the lithium battery sector, and promote the healthy development of tech in the industry, it stressed.

LG Energy has accused Eve Energy's lithium-ion batteries of infringing some of its patents, said Tulip Innovation, an independent patent operation company co-founded by LG Energy and Panasonic Energy. The asserted patents cover tablet cell tech, separator tech, and cell safety features, which are critical in enabling increased performance in power applications while maintaining safety, it noted.

LG Energy seeks to address extensive infringement in the US power tool market, which has widely adopted these patented cell tech, Tulip Innovation stressed.

The new case is a continuation of active enforcement efforts within Tulip Innovation's battery licensing program, which recently resulted in a patent license agreement with Chinese battery supplier Sunwoda Electronic that resolved its pending actions in Germany and South Korea.

Shares of Eve Energy [SHE: 300014] ended 2.1 percent higher at CNY55.11 (USD8.14) each today. The wider Shenzhen market rose 2.7 percent.
